This U.S. Consumer Privacy Notice (“Notice”) is provided on behalf of Seagate Technology LLC and any of its affiliates, (collectively, “Seagate” or “we” or “us”) and provides supplemental information on Seagate's collection, use and disclosure of Personal Information and the rights available to certain U.S. residents. In addition, please refer to Seagate’s general Privacy Statement available at https://www.seagate.com/legal/privacy/privacy-policy/ (“Statement”) for more information about our privacy practices. Capitalized terms used in this Notice that are not otherwise defined in this Notice are as defined in the Statement. Please note that this Notice does not apply in situations where we collect Personal Information about our job applicants, employees, contractors, owners, directors, or officers as it relates to their current, former, or potential role at Seagate.

If you reside in California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, this page applies to you and supplements Seagate's Statement.
 

Collection of Personal Information

We collect certain "personal information" from consumers. “Personal Information” is information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. 

Personal Information does not include:

  • Publicly available information from government records or information that has lawfully been made available to the general public by the consumer or from widely distributed media;
  • De-identified or aggregated information;
  • Information excluded from the scope of applicable state law, such as:
    • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and relevant state laws such as the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;
    • Personal information that is covered by certain other privacy laws, like the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) and relevant state laws such as the California Financial Information Privacy Act (FIPA).
       

Categories of Personal Information

We collect Personal Information from our interactions with you. For example, when you contact us via our Site or on the phone, respond to a survey, or register a Seagate product. We also collect Personal Information from other sources, for example when public databases and joint marketing partners share the information with us, in accordance with applicable law.

We may have collected and processed within the last 12 months the following categories of Personal Information:

  • Identifiers, such as your name, telephone number, postal address, email address, and other contact information and profile picture user account name, and IP address;
  • Commercial information, such as transaction information and purchase history;
  • Internet or network activity information, such as your browsing history and interactions with our Site;
  • Geolocation data, such as your approximate location based on your IP address;
  • Audio, electronic, visual, and similar information, such as call recordings;
  • Professional or employment-related information, such as your title or industry;
  • Account user ID which may be combined with a password or other security credentials (if you have an account with us), which may be considered sensitive personal information  depending on your state of residence; and
  • Inferences drawn from any of the above Personal Information to create a summary about you such as your preferences and characteristics. 
     

Sources of Personal Information

We may obtain the categories of Personal Information listed above from the following categories of sources:

  • Directly from you – for example, when you contact us via our Site or on the phone, respond to a survey, register a Seagate product or complete other online forms;
  • Indirectly from you – for example, from your device when you access our Site or Offerings or from observing your actions on our Site or Offerings;
  • From third parties that assist us in providing relevant services for our Site or Offerings;
  • From joint marketing partners that share the information with us; and
  • From public sources (such as public records).
     

Use of Personal Information

We may use your Personal Information described in this Notice to operate, manage, and maintain our business, to provide our Site and Offerings, for our vendor management purposes, and to accomplish our business purposes and objectives. For example, we may use your Personal Information to:

  • Perform the services or provide the goods you request;
  • Create, maintain, customize, and secure your account with us;
  • Provide customer service and support, including investigating your concerns, responding to your requests, and monitoring and improving our responses;
  • Develop, improve, repair, and maintain our Site and Offerings;
  • Personalize, advertise, and market our products and services;
  • Conduct research and data analysis;
  • Engage in automated processing, including the use of artificial intelligence to analyze Personal Information;
  • Undertake activities to verify or maintain the quality of our Site and Offerings and to improve, upgrade, or enhance our Site and Offerings;
  • Conduct risk and security control and monitoring to maintain the safety, security, and integrity of our Sites, Offerings, databases and other technology assets, and business;
  • Detect and prevent fraud;
  • Perform identity verification;
  • Perform accounting, audit, and other internal functions, such as internal investigations;
  • Comply with law, legal process, and internal policies;
  • Respond to law enforcement requests and as required by applicable law, court order, or governmental regulations;
  • Maintain records;
  • Exercise and defend legal claims; and
  • Evaluate or conduct dissolution, divestiture, restructuring, reorganization, merger, or other sale or transfer of some or all our assets, including as part of bankruptcy, liquidation, or similar proceedings.
     

We may collect and process the sensitive personal information described in this Notice to:

  • Perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services;
  • Help ensure the security and integrity of our Site and Offerings;
  • Perform services on behalf of our business, including to maintain or service accounts, provide customer service, process or fulfill orders and transactions, verify customer information, process payments, provide analytic services, provide storage, or provide similar services; and
  • Undertake activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by us.
     

Retention of Personal Information

We will retain your Personal Information for as long as needed or permitted in light of the purpose(s) for which it was obtained.

The criteria used to determine our retention periods include: (i) the length of time we have an ongoing relationship with you and to provide the Site or Offerings to you (for example, for as long as you have an account with us or keep using the Site or Offerings); (ii) whether there is a legal or business obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or (iii) whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations regulatory investigations, or other legal matters).
 

Disclosures of Personal Information

In the past 12 months, we may have disclosed the above categories of Personal Information to third parties, such as our service providers and affiliates, for our operational business purposes, as described in the Statement.

Third parties with whom we may share Personal Information include:

  • Affiliates and Subsidiaries: We may share Personal Information with our affiliates and subsidiaries for our operational business purposes.
  • Service Providers: We may share Personal Information with service providers, such as for technical or customer support, web or data hosting, payment processing, billing, accounting, analytics, auditing, legal consultancy, security, marketing, or otherwise developing, maintaining, and improving our business, our Site, and our Offerings.
  • Parties Involved with Business Transfers: We may share Personal Information with third parties in the event we sell or transfer all or a portion of our business or assets (including in the event of a merger, acquisition, joint venture, reorganization, divestiture, dissolution or liquidation).

When we disclose Personal Information for a business purpose, we enter into a contract that describes the purpose and requires the recipient to both keep that Personal Information confidential and not use it for any purpose except fulfilling the contract.
 

Sales and Sharing of Personal Information

We do not "sell" Personal Information for monetary consideration. We do not sell or share Personal Information of individuals who we know are under 16 years of age, nor do we sell or share "sensitive personal information" as defined by applicable law.

Like many websites, our Site uses cookies and other tracking technologies to provide you with a more personalized experience and targeted advertising, if you choose to enable such cookies. These cookies may be considered 'sharing' of Personal Information under certain state laws. These cookies are disabled by default and require your permission before they are enabled. If you choose to enable such cookies, we and our partners will use cookies as instructed by you to deliver and measure the effectiveness of ads, display personalized ads and content based on your interests (depending on your settings) and improve our products and services. Categories of Personal Information that may be shared (if you choose to enable such cookies) are identifiers and Internet or other similar network activity. Categories of third parties to whom Personal Information may be shared (if you choose to enable such cookies) are data analytics providers, social media, advertising and marketing providers.

U.S. State Privacy Rights

If you are a resident of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the following rights concerning your Personal Information, subject to certain limitations and exceptions.

Access and Information. You have the right to request that we:

  • Confirm whether we process Personal Information about you; and
  • Provide you with access to such Personal Information and, where required, additional information about our data practices, such as the categories of Personal Information we collect, the categories of sources of that information, the purposes for which we collect and use it, and the categories of third parties to whom we disclose it.

In California, this may include the right to request, for the 12-month period preceding your request, information about the categories and specific pieces of Personal Information we have collected about you, the categories of sources and third parties, and the business or commercial purposes for the collection, use, and disclosure of Personal Information.

When responding to access requests, we will not disclose trade secrets or other information that we are legally prohibited from disclosing.

Data Portability. You have the right to obtain a copy of your Personal Information in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance. In some states, this right may apply only to Personal Information that you have provided to us and only where processing is carried out by automated means, and we will not be required to disclose trade secrets.

Correction. In some states, you have the right to request that we correct inaccuracies in the Personal Information we maintain about you, taking into account the nature of the Personal Information and the purposes for which we process it.

Deletion. You have the right to request that we delete certain Personal Information we have collected about you. Depending on your state, this right may apply to Personal Information you have provided to us, Personal Information we have obtained about you from other sources, and, in some states, certain derived data. We may retain Personal Information where an exception applies, such as where retention is necessary for us to comply with legal obligations or to establish, exercise, or defend legal claims.

Right to Opt Out of Certain Processing. You may have the right to direct us not to:

  • Sell your Personal Information to third parties;
  • Share or use your Personal Information for targeted advertising or cross-context behavioral advertising; and
  • Process your Personal Information for profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

As described in the section on “Sales and Sharing of Personal Information,” we do not sell Personal Information to third parties, or process Personal Information for the purpose of profiling in connection with decisions that produce legal or similarly significant effects. We do process Personal Information for the purpose of displaying targeted advertisements, if you instruct us to do so (which could be deemed “sharing” of Personal Information for “cross-context behavioral advertising under California law). You may modify your cookies choices at any time by clicking the ‘Cookie Settings’ link in the footer of our website.

Right to Obtain a List of Certain Third Parties. In some states, you may have the right to request a list of specific third parties to whom we have disclosed your Personal Information. Where we do not maintain this information at the individual consumer level, we may instead provide a list of specific third parties to whom we have disclosed any consumer’s Personal Information.

Right to Appeal. In states where this right is provided, you may have the right to appeal our decision if we decline to take action on your request. If an appeal submitted in line with the section on “Submitting Rights Requests and Appeals” is denied, you may contact your State Attorney General’s office or State Department of Justice.

Non-discrimination. You have the right to be free from unlawful discrimination for exercising your rights under applicable state law.
 

Additional Rights for California Residents

Limit the Use and Disclosure of Sensitive Personal Information. The California Privacy Rights Act (“CPRA”) gives residents the right to limit the use and disclosure of “sensitive personal information” to certain permitted purposes. We do not use or disclose "sensitive personal information,” as defined by the CPRA, other than as described in the Section "Use of Personal Information" above or as otherwise permitted under applicable privacy law. Seagate does not process information that is subject to this limitation, nor does Seagate use such information to infer characteristics about you. As a result, we do not offer an ability to limit the use of sensitive personal information. 

Direct Marketing Disclosures. California’s “Shine the Light” law (Civil Code Section § 1798.83) permits residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. We do not disclose Personal Information to third parties for their direct marketing purposes.
 

Limitations and Exceptions

Please note that the above rights are not absolute and may be subject to limitations under applicable law. We may deny a request where we are unable to verify your identity, where responding would adversely affect the rights or freedoms of others, or where a legal exception applies. In addition, certain state laws limit how often consumers may exercise these rights free of charge within a 12-month period. We may charge a reasonable fee or refuse to act on a request that is manifestly unfounded, excessive, repetitive, or otherwise permitted by law.
 

Submitting Rights Requests and Appeals

To protect the Personal Information that we maintain, we may verify your identity when you make a request that is not a request to opt out of certain processing (which can be submitted by clicking on the Cookies Settings link in the footer of our website and changing your preferences). To verify your identity, we may request your first and last name, email address related to your account, or country and state of residence.

Like many websites, our Site uses cookies and other tracking technologies to provide you with a more personalized experience and targeted advertising, if you choose to enable such cookies.  You may modify your cookies choices at any time by clicking the ‘Cookies Settings’ link in the footer of our website.

In certain states, an authorized agent may submit a rights request on your behalf by contacting us at [email protected]. We may require an authorized agent to verify their authority to submit a request on your behalf, or we may require you to verify your own identity or confirm with us that you provided the agent with permission to submit the request. We will only use the information provided for verification to confirm the requestor’s identity or authority to make the request, and for our compliance records.

We endeavor to respond to a verifiable request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.

We may make changes to this Notice. Notification of changes will be posted on this page. You should review this Notice periodically to keep up to date on our most current policies and practices.
